  2.  Before installing and using any of the program materials
  3.  on this CD-ROM, you must read and agree to the terms of 
  4.  the IBM EVALUATION AGREEMENT, below.  Clicking on
  5.  CONTINUE, indicates your agreement to these terms and
  6.  conditions.

  8.  The Trial copy of VisualAge C++ on this CD-ROM, contains a
  9.  time limiting device which is activated when you first
  10.  install the program.  This device will monitor your use of
  11.  the program during the 60 day evaluation period.  At the
  12.  end of the evaluation period the device will prevent the
  13.  program from operating.

  17.                         IBM EVALUATION AGREEMENT

  19.  This is a no charge Evaluation License ("License") between
  20.  you and International Business Machines Corporation
  21.  ("IBM") for the evaluation of IBM's software and related
  22.  documentation. ("Program")
  23.  
  24.  IBM grants you a non-exclusive, non-transferable license
  25.  to the Program only to enable you to evaluate the
  26.  potential usefulness of the Program to you. You may not
  27.  use the Program for any other purpose and you may not
  28.  distribute any part of it, either alone or with any of
  29.  your software products.
  30.  
  31.  IBM retains ownership of the Program and any copies you
  32.  make of it. You may use the Program on one (1) machine
  33.  only.
  34.  
  35.  You may not decompile, disassemble or otherwise attempt to
  36.  translate or seek to gain access to the Program's source
  37.  code.
  38.  
  39.  The term of your License will be from the date of first    
  40.  installation of the Program, and will terminate 60 days    
  41.  later, unless otherwise specified.  THE PROGRAM WILL STOP  
  42.  FUNCTIONING WHEN THE LICENSE TERM EXPIRES.  You should     
  43.  therefore take precautions to avoid any loss of data that  
  44.  might result.  You must destroy and/or delete all copies   
  45.  you have made of the Program within ten (10) days of the   
  46.  expiry of your License.

  48.  If you are interested in continuing to use the Program
  49.  after the end of your License, you must place an order for
  50.  a full license to the Program and pay the applicable
  51.  license fee. In that event, your use of the Program will
  52.  be governed by the provisions of the applicable IBM
  53.  license for the Program.

  55.  IBM accepts no liability for damages you may suffer as a
  56.  result of your use of the Program. In no event will IBM be
  57.  liable for any indirect, special or consequential
  58.  damages, even if IBM has been advised of the possibility
  59.  of their occurrence.

  61.  YOU UNDERSTAND THAT THE PROGRAM IS BEING PROVIDED TO YOU
  62.  "AS IS", WITHOUT ANY WARRANTIES (EXPRESS OR IMPLIED)
  63.  WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY IMPLIED
  64.  WARRANTIES OF MERCHANTABILITY, QUALITY, PERFORMANCE OR
  65.  FITNESS FOR ANY PARTICULAR PURPOSE. Some jurisdictions do
  66.  not allow the exclusion or limitation of warranties or
  67.  consequential or incidental damages, so the above may
  68.  not apply to you.

  70.  IBM may terminate your License at any time if you are in
  71.  breach of any of its terms.

  73.  This License will be governed by and interpreted in
  74.  accordance with the laws of the State of New York.

  76.  This License is the only understanding and agreement we
  77.  have for your use of the Program. It supersedes all other
  78.  communications, understandings or agreements we may have
  79.  had prior to this License.
